Stepparent adoptions, especially, are common in blended families when a stepparent wants to obtain formal legal rights and responsibilities in relation to a stepchild. In order for a stepparent to adopt a child, the second biological parent must first give up his or her parental rights. The biological parent can consent to relinquish parental rights, or the stepparent can ask the court to terminate parental rights in a contested hearing.
Termination of parental rights when the biological parent does not consent to the adoption is extremely difficult except in situations where there is evidence of abuse or neglect, or when the biological parent will be absent for a long period of time (for example, a long prison sentence).
